1. Acceptance of Terms
By accessing or using the Drive Auto Body website at driveautobody.com (the "Site"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Site or our services. Drive Auto Body reserves the right to update these Terms at any time. Continued use of the Site after changes constitutes acceptance of the revised Terms.
2. Use of Website
This Site is provided for informational purposes and to facilitate communication between Drive Auto Body and its customers. You agree to use the Site only for lawful purposes and in a manner that does not infringe upon or restrict the use and enjoyment of the Site by any third party. You may not:
- Use the Site in any way that violates any applicable federal, state, or local law or regulation.
- Attempt to gain unauthorized access to any portion of the Site or any systems or networks connected to the Site.
- Use the Site to transmit any harmful, threatening, abusive, or otherwise objectionable material.
- Reproduce, duplicate, copy, or otherwise exploit any material on the Site for commercial purposes without our express written consent.
3. Repair Estimates and Authorization
Drive Auto Body provides free estimates for collision repair, paint, and related auto body services. All estimates are based on a visual inspection and are subject to change once the vehicle is disassembled and hidden damage is discovered. Supplemental estimates may be required and will be communicated to you and your insurance company (if applicable) before additional work is performed.
No repairs will begin without your express authorization. By signing a repair authorization form -- whether in person, electronically, or via written communication -- you authorize Drive Auto Body to perform the agreed-upon repairs. You are responsible for payment of all authorized repairs not covered by your insurance.
4. Insurance Claim Assistance
Drive Auto Body assists customers with the insurance claims process as a courtesy. We work with all major insurance carriers and will communicate with adjusters, submit documentation, and file supplements on your behalf. However, Drive Auto Body is not an insurance company, broker, or adjuster. We do not guarantee any specific insurance outcome, coverage decision, or claim approval. All insurance coverage decisions are made solely by your insurance carrier in accordance with your policy.
Under California Insurance Code Section 758.5, you have the right to choose any licensed body shop for your collision repairs. Drive Auto Body will advocate on your behalf, but final decisions regarding coverage and payment remain between you and your insurer.
5. Lifetime Warranty on Workmanship
Drive Auto Body stands behind its work with a LIFETIME WARRANTY on workmanship for as long as you own the vehicle. This warranty covers defects in the quality of repair work performed by Drive Auto Body, including but not limited to paint adhesion, color match, body panel alignment, and structural repairs performed by our technicians.
This warranty does not cover:
- Damage caused by subsequent accidents, collisions, or impacts.
- Normal wear and tear, including stone chips, scratches, fading due to environmental exposure, or deterioration from lack of proper vehicle maintenance.
- Damage resulting from modifications or repairs performed by any party other than Drive Auto Body after the original repair.
- Parts or components covered under their own separate manufacturer warranty.
To make a warranty claim, contact us directly at (951) 268-3006 or info@driveautobody.com. You must present the vehicle for inspection at our facility. The warranty is non-transferable and applies only to the original vehicle owner at the time of repair.
6. $500 Off Deductible Promotion
Drive Auto Body may offer a "$500 Off Your Deductible" promotion from time to time. The following terms apply to this promotion:
- The promotion applies to qualifying collision repair jobs where the customer has an insurance deductible.
- The discount amount is up to $500 and may not exceed the actual deductible amount owed by the customer.
- This promotion cannot be combined with other offers, discounts, or promotions unless explicitly stated.
- Drive Auto Body reserves the right to modify, suspend, or discontinue this promotion at any time without prior notice.
- The promotion applies to labor and/or materials provided by Drive Auto Body. It does not constitute a payment to or from any insurance company.
- Eligibility and final discount amount are determined at the sole discretion of Drive Auto Body.
7. Payment Terms
Payment for services is due upon completion of repairs and before the vehicle is released. Drive Auto Body accepts cash, checks, and major credit cards. If your repair is covered by insurance, you are responsible for your deductible and any charges not covered by your insurance policy. Drive Auto Body reserves the right to retain possession of a vehicle until all outstanding charges are paid in full, in accordance with California law.
8. Limitation of Liability
To the fullest extent permitted by applicable law, Drive Auto Body, its owner Claudia Oseguera, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or our services. This includes, without limitation, damages for loss of profits, data, use, goodwill, or other intangible losses.
Drive Auto Body's total liability to you for any claim arising out of or relating to these Terms or our services shall not exceed the amount you paid to Drive Auto Body for the specific repair or service giving rise to the claim.
The Site and all content therein are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
9. Indemnification
You agree to indemnify, defend, and hold harmless Drive Auto Body, its owner, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your use of the Site, your violation of these Terms, or your violation of any rights of another person or entity.
10. Third-Party Links
The Site may contain links to third-party websites or services that are not owned or controlled by Drive Auto Body. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that Drive Auto Body shall not be responsible or liable for any damage or loss caused by the use of any such content or services.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts located in Riverside County, California, and you consent to the personal jurisdiction of such courts.
12. Severability
If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
